Terms & Conditions of Sale
1. Quotations All quotations are valid for 30 days unless otherwise stated. Prices are exclusive of GST unless specified. Quotations are subject to stock availability and supplier confirmation at the time an order is placed.
2. Pricing & Supplier Increases Should manufacturer or supplier pricing increase after the quotation date but prior to order confirmation or dispatch, Chione Hospitality Group reserves the right to adjust pricing accordingly. Customers will be advised of any such adjustment before dispatch wherever practicable.
3. Freight & Delivery Freight charges are based on carrier rates applicable at the date of quotation. Freight costs, fuel surcharges, remote area charges and other transport-related costs imposed by carriers may be adjusted prior to dispatch. Delivery dates are estimates only and are subject to supplier availability, transport delays and circumstances beyond our control.
4. Deposits & Payment Unless otherwise agreed in writing, a 50% deposit is required to place an order, with the balance payable prior to dispatch. Interest may be charged on overdue accounts together with any reasonable debt recovery costs incurred.
5. Special Order Items Special order, custom-built or non-stock items cannot be cancelled or returned once an order has been placed with the manufacturer unless agreed in writing. Any cancellation accepted may incur supplier cancellation or restocking charges.
6. Installation & Site Requirements The purchaser is responsible for ensuring the site is ready for installation, including all electrical, gas, plumbing, drainage, ventilation and building works. Any additional labour, waiting time or return visits resulting from site delays or incomplete services will be charged accordingly.
7. Warranty Equipment is supplied with the manufacturer's warranty. Warranty does not cover misuse, accidental damage, incorrect installation by others, inadequate maintenance, unsuitable water quality or unauthorised repairs. Reverse Osmosis (RO) filtration is mandatory where specified by the manufacturer.
8. Inspection of Goods The purchaser must inspect all goods upon delivery and notify Chione Hospitality Group of any shortages, damage or incorrect items within 48 hours of delivery.
9. Retention of Title Ownership of all goods remains with Chione Hospitality Group until payment has been received in full, notwithstanding delivery to the purchaser.
10. Limitation of Liability To the maximum extent permitted by law, Chione Hospitality Group shall not be liable for indirect, consequential or economic loss arising from the supply, installation or use of any equipment.
11. Force Majeure Chione Hospitality Group shall not be liable for delays or failure to perform due to events beyond its reasonable control including supplier delays, shipping disruptions, industrial disputes, natural disasters, pandemics, government actions, war or transport interruptions.
12. Governing Law These Terms & Conditions are governed by the laws of Western Australia.
13. Finance Approval Where equipment is being financed, acceptance of any finance application remains subject to the approval of the finance provider. Chione Hospitality Group accepts no responsibility for declined finance applications.
14. Water Quality Where specified by the manufacturer, approved water filtration or Reverse Osmosis (RO) systems must be installed and maintained. Warranty claims arising from poor water quality, scale build-up or failure to maintain filtration systems may be rejected by the manufacturer and are not the responsibility of Chione Hospitality Group.
15. Entire Agreement These Terms & Conditions, together with the quotation or tax invoice, constitute the entire agreement between Chione Hospitality Group and the purchaser unless otherwise agreed in writing.
Acceptance of a quotation, placement of an order, payment of a deposit or acceptance of delivery constitutes acceptance of these Terms & Conditions.
